RENTAL TERMS AND CONDITIONS

1. INTRODUCTION AND ACCEPTANCE OF TERMS
These Terms and Conditions (hereinafter, the “Terms”) govern the contractual relationship between the booking holder (hereinafter, the “Guest”), the property owner (hereinafter, the “Owner”), and Villas&You Holiday Rentals Agency (hereinafter, the “Agency”), in relation to the short-term or seasonal rental of holiday accommodation.

By making a reservation, the Guest expressly acknowledges that they have read, understood, and fully accepted these Terms in their entirety, without limitation or reservation. These Terms shall prevail over any other prior agreement, representation, or communication.

2. ROLE OF THE AGENCY
The Agency acts solely as an intermediary between the Owner and the Guest. The Agency does not own, control, or manage the properties beyond coordination, marketing, and administrative services.

The Agency shall not be held liable for:

* The physical condition of the property
* Interruptions in utilities or services
* Acts or omissions of the Owner
* Any damages, injuries, losses, or inconveniences suffered during the stay

All contractual obligations regarding the property lie directly between the Guest and the Owner.

3. BOOKINGS AND PAYMENTS
3.1 Reservation Confirmation
A reservation shall only be considered confirmed upon receipt of the required payment as specified on the Agency’s website or booking platform.

3.2 Non-Refundable Payments
Any amount paid to reserve a property is strictly non-refundable under any circumstances, including but not limited to cancellations, travel disruptions, force majeure, or personal reasons.

3.3 Payment Schedule
All payments must be made in accordance with the schedule stated at the time of booking. Failure to comply with the agreed payment schedule shall constitute a material breach.

3.4 Non-Payment
If any payment remains outstanding for more than seven (7) days past its due date, the Agency reserves the right to cancel the booking automatically without prior notice and without any refund of amounts already paid.

4. SECURITY DEPOSIT
A security deposit is mandatory for all bookings. The amount shall be specified prior to arrival.

The deposit may be retained partially or in full to cover:

* Damage to the property or its contents
* Excessive cleaning requirements
* Breach of house rules
* Unauthorized occupancy or activities
* Loss, theft, or misplacement of keys, fobs, or access devices
* Locksmith services, replacement of locks, or security interventions

The Guest agrees that the Agency and/or Owner shall have sole discretion in assessing damages and deductions.

5. CHECK-IN AND CHECK-OUT
5.1 Check-in Time
Check-in shall take place from 16:00 hours onward.

5.2 Key Collection
Keys shall be collected from one of the secure key boxes located outside the Villas&You office. Instructions will be provided prior to arrival. The Guest assumes full responsibility for the safekeeping of keys.

5.3 Check-out Time
Check-out must be completed no later than 10:00 hours on the departure date.

Late check-out without prior authorization may result in additional charges or penalties, including compensation for affected incoming reservations.

6. IDENTIFICATION AND LEGAL COMPLIANCE
In compliance with applicable Spanish law, all Guests are required to provide valid identification (passport or national ID) prior to arrival.

Failure to provide such documentation may result in denial of access to the property without refund.

7. USE OF THE PROPERTY
7.1 Permitted Use
The property is rented exclusively for temporary accommodation purposes. Commercial activities are strictly prohibited.

7.2 Maximum Occupancy
The number of occupants must not exceed the limit specified in the booking. Unauthorized additional guests are strictly forbidden.

7.3 Conduct and Behaviour
Guests must:

* Respect neighbours and the surrounding community
* Avoid noise disturbances, especially during nighttime hours
* Refrain from any illegal, antisocial, or disruptive behavior

7.4 Strict Prohibition of Parties and Events
Parties, events, gatherings, or celebrations of any kind are strictly prohibited. Breach of this clause will result in immediate termination of the stay without refund and possible forfeiture of the security deposit.

7.5 Prohibited Activities
The property must not be used for illegal purposes, subletting, filming without authorization, or any activity that may damage the reputation of the Owner or Agency.

8. PROPERTY CONDITION AND DISCLAIMER
8.1 General Condition
The Guest acknowledges that the property is a rental accommodation and may show normal signs of wear and tear.

Such conditions shall not entitle the Guest to any compensation, refund, or complaint.

8.2 Variations from Advertised Material
The Guest accepts that the property may differ slightly from photographs or descriptions due to:

* Replacement of furniture or appliances
* Maintenance updates
* Minor aesthetic variations

No claims shall arise from such differences.

8.3 Inventory
Any inventory provided is for guidance only. Missing or substituted items do not constitute a basis for compensation.

8.4 Security Systems
Some properties may be equipped with alarm systems and security cameras. Villas&You has no access to these cameras, and their presence forms part of the property’s security.

9. MAINTENANCE AND BREAKDOWNS
The Agency and Owner do not guarantee uninterrupted functionality of:

* Utilities (water, electricity, gas, internet)
* Appliances or equipment
* Community facilities (pools, lifts, etc.)

Any reported issue will be addressed within a reasonable timeframe; however, no compensation shall be provided for inconvenience or temporary loss of services.

Emergency repairs may require access to the property without prior notice when reasonably necessary.

10. LIABILITY WAIVER
To the fullest extent permitted by law, the Agency and the Owner shall not be liable for:

* Personal injury, illness, or death
* Loss, theft, or damage to personal belongings
* Accidents occurring within or around the property
* Misuse of facilities, including pools, terraces, balconies, or equipment
* Failures or interruptions of third-party services
* Force majeure events (including but not limited to natural disasters, pandemics, strikes, or government restrictions)

Guests use the property entirely at their own risk.

11. CANCELLATIONS AND MODIFICATIONS
All bookings are strictly non-refundable. No cancellations, amendments, or date changes shall entitle the Guest to any refund or credit unless explicitly stated otherwise in writing.

12. LONG-TERM BOOKINGS
Bookings of extended duration may be subject to specific conditions outlined in a separate seasonal rental contract. In the event of conflict, the seasonal contract shall prevail.

13. BREACH OF TERMS
Any breach of these Terms may result in:

* Immediate termination of the stay
* Eviction without refund
* Retention of the security deposit
* Additional charges for damages or losses
* Notification to authorities where applicable

14. CLEANING AND DEPARTURE OBLIGATIONS
Guests must leave the property in a reasonable condition, including:

* Disposal of rubbish
* Basic cleaning
* Proper use of facilities

Failure to comply may result in additional cleaning charges.

Excessive dirt, stains, or improper disposal of waste may incur extra fees.

15. PETS AND SMOKING
Unless explicitly authorized:

* Pets are not permitted
* Smoking inside the property is strictly prohibited

Violation may result in penalties and additional cleaning costs, including deodorization or repairs.

16. DATA PROTECTION
Personal data provided by Guests will be processed in accordance with applicable data protection laws and solely for the purpose of managing the booking and complying with legal obligations.

17. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of Spain. Any disputes shall be subject to the exclusive jurisdiction of the courts corresponding to the location of the property.

18. FINAL PROVISIONS
The Agency reserves the right to amend these Terms at any time without prior notice. The version applicable shall be the one in force at the time of booking.

If any provision is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19. ADDITIONAL LIABILITY LIMITATIONS
Without prejudice to the above:

* The Agency and Owner shall not be responsible for construction works, noise, or disturbances beyond their control
* No liability is assumed for failures in air conditioning, heating, or internet
* The Agency is not responsible for third-party platforms, payment providers, or travel arrangements
* Guests are responsible for securing their belongings and locking the property at all times
* Forgotten items are not the responsibility of the Agency or Owner
* The Agency shall not be liable for delays, access issues, or technical faults related to key boxes
* Parking, if available, is at the Guest’s own risk
* Use of pools or common areas is entirely at the Guest’s own responsibility
* The presence of alarm systems and security cameras is the Guest’s responsibility to respect and use properly; Villas&You has no access to these cameras
